Kim Quoted on DOJ Appeal on Tariff Refunds

Partner James Kim was quoted on how the most recent filing from the US Department of Justice flagging its intention to appeal the judge’s order requiring tariff refunds for all eligible importers is causing additional uncertainty in an already precarious process.
US Customs and Border Protection’s (CBP) current refund process has worked well for straightforward refund petitions. However, CBP has not explained how it will process other claims outside that process.
James said that the DOJ’s filing makes it “pretty clear that the government is not going to just simply start issuing refunds for these finally liquidated entries.”
“I do expect more companies will start considering taking proactive action, like filing protests or filing lawsuits if they haven’t already,” he added, and that firms may pursue a “belt and suspenders approach” to ensure access is preserved.
